Governor Newsom's challenge to Trump's military orders in LA reaches the Ninth Circuit with high-profile support.
The 9th Circuit Court will hear arguments Tuesday in a high-profile legal battle between President Trump and Governor Newsom over who has authority to control California’s National Guard.
Newsom’s remarks came moments after a federal judge ordered Trump to relinquish control of California’s National Guard troops, ruling his deployment of the Guard to Los Angeles was illegal and unconstitutional. But hours later, a three-judge panel of the 9th Circuit Court of Appeals blocked the order, setting a Tuesday hearing on the matter.
“The district court has no authority to usurp the president’s authority as commander in chief,” Kelly said in an emailed statement to the Southern California News Group. “The president exercised his lawful authority to mobilize the National Guard to protect federal buildings and personnel in Gavin Newsom’s lawless Los Angeles.”
