Magistrate Judge André M. Espinosa scolded interim U.S. Attorney Alina Habba after the dropped charge against Newark Mayor Ras Baraka.

Interim U.S. Attorney for New Jersey Alina Habba, Trump’s personal attorney, appeared on Fox News on May 9 shortly after federal agents arrested Baraka during a protest outside the facility, which has been the site of ongoing demonstrations demanding transparency about the conditions inside.

Magistrate Judge André M. Espinosa granted what he called the “embarrassing retraction” of the trespassing charge following a May 9 incident.

Democrats have denounced the charges as politically motivated and an effort by the Trump administration to intimidate member of Congress and chill oversight.

The complaint was presented to a U.S. magistrate judge shortly before New Jersey’s interim U.S. attorney, Alina Habba, announced the charge.
